A quid pro quo arrangement is one in which two things are exchanged. Each party has something that the other party wants, and they agree to that exchange.
However, in the context of sexual harassment, quid pro quo harassment is often a form of manipulation. It is important for employees to know how this works and what rights and options they have if it happens to them.
Positive workplace advancement
For example, there may be a significant power imbalance between two individuals. Perhaps one is a supervisor or a manager at a business, while the other is a low-level employee who wants to advance in the hierarchy.
The person in the higher position of power may tell the other employee that, in exchange for a sexual relationship, they will make sure that the employee gets promotions, raises, bonuses or valuable work opportunities. They are essentially trying to manipulate that person into a relationship they otherwise would not consent to.
At the same time, the implication may be that the employee will see negative ramifications if they refuse. If someone’s boss tries to set up a quid pro quo arrangement and the lower-level employee refuses to participate, they may worry about being terminated or having their hours or wages cut. They may also be concerned that, if they are up for a promotion that they deserve, they will be passed over.
Employee rights
Employees should not be manipulated into relationships by those in positions of power, but it does happen. Those who find themselves facing this type of sexual harassment on the job must be aware of all of the legal steps they can take, and it may help to work with an experienced law firm.
